BIRD’S BASEMENT TERMS AND CONDITIONS

1. Refund Policy for Tickets and Pre-Purchased Goods

1.1 Tickets and pre-purchased goods may be refunded in full, less applicable service fee(s), where cancellation is received more than fourteen (14) days prior to the scheduled performance.

1.2 Tickets and pre-purchased goods cancelled fourteen (14) days or less prior to the scheduled performance will incur a twenty-five per cent (25%) cancellation fee, in addition to any applicable service fee(s).

1.3 No refunds are provided on the day of the show.

1.4 Tickets purchased in grouped quantities are refundable only in the same grouping in which they were sold, including:
(i) tickets sold in multiples of two (2); and
(ii) tickets sold in multiples of three (3).

1.5 Premium Plus Table tickets are sold as a single, indivisible ticket conferring exclusive use of one table seating two (2) to four (4) persons.

1.6 Premium Plus Table tickets cannot be split, fragmented, or partially refunded. Any approved refund applies to the entire table only.

1.7 All refund requests must be submitted in writing by SMS text message only to 0403 454 152.

1.8 Refund requests made via voicemail, email, telephone calls, social media, or any other method will not be accepted.


2. No-Shows and Lateness

2.1 A ticket will be deemed a no-show if the Ticket Holder has not arrived by 7:30pm. Bird’s Basement reserves the right to reallocate the seat.

2.2 Clause 2.1 does not apply where the Ticket Holder has advised their expected arrival time by SMS to 0403 454 152 prior to 7:30pm.

2.3 No-shows are not eligible for any refund, including where the seat has been resold or occupied.

2.4 To minimise disruption, Bird’s Basement reserves the right to refuse entry to patrons arriving after 7:30pm.

2.5 Doors open from 6:00pm. Patrons are encouraged to arrive early.


3. Artist Cancellation

3.1 If an artist cancels on the day of the performance, Bird’s Basement may substitute the artist with a suitable replacement.

3.2 If cancellation occurs one (1) day or more prior to the performance and no replacement is provided, the ticket price will be refunded using the original payment method.


4. Seating Arrangements

4.1 Bird’s Basement endeavours to seat groups together in accordance with the venue seating plan. Up to twelve (12) tickets may be purchased per transaction, and multiple transactions may be made for larger groups. Larger groups may be seated across multiple tables, subject to availability.


5. Seating Categories and Allocation

5.1 Seating will be within the section corresponding to the tickets purchased, as defined in the venue plan on the Bird’s Basement website.

5.2 Seating is allocated in advance and cannot be changed on the night, except as set out below.

5.3 Seating requests must be made at the time of booking.

5.4 Seating requests cannot be guaranteed, are allocated based on group size and availability, and are withdrawn after 6:30pm on the day of the show.

5.5 Bird’s Basement reserves discretion to allocate or reallocate seating as required for operational, venue, or accessibility reasons, including allocation to a different seating category, in accordance with these Terms and Conditions.

5.6 Wheelchair-accessible seating is available exclusively within the A-Reserve category.

5.7 Patrons requiring wheelchair-accessible seating must select the wheelchair access option at the time of booking.

5.8 Wheelchair access is via The Jazz Corner Restaurant & Bar, 352 William Street.


6. Seating Plan Changes

6.1 Bird’s Basement reserves the right to amend the seating plan without notice.


7. Tickets, Views and Minimum Spend

7.1 All tickets provide entry to the performance only and do not include food or beverages.

7.2 Seating is classified as Dining Priority or Non-Dining Priority. The best views are reserved for Dining Priority seating.

7.3 Dining Priority seating is subject to a minimum food spend of $30 per person (food only), redeemable on the night.

7.4 Non-Dining Priority seating is subject to a minimum spend of $15 per person. All seating categories may order food from their tables.


8. Admission and Eviction

Bird’s Basement management reserves the right to refuse admission or evict patrons for reasons including safety, behaviour, dress code breaches, obstruction of walkways, or non-compliance with these Terms and Conditions.


9. Dress Code

The minimum dress standard is smart casual. Entry may be denied for inappropriate attire. Items not permitted include sports caps, thongs, men’s casual or athletic shorts, or sleeveless singlets.


10. Responsible Service of Alcohol

Bird’s Basement complies with Responsible Service of Alcohol laws at all times.


11. Underage Patrons

Patrons under eighteen (18) years of age must be accompanied by a responsible parent or guardian, and each person must purchase food.


12. Pricing Errors

Bird’s Basement reserves the right to cancel tickets issued due to pricing errors and to refund payments made.


13. Weekend and Public Holiday Surcharge

A surcharge of 10% applies on Saturdays and 15% applies on Sundays and public holidays to food and beverage purchases.


14. Acceptance and Enforceability

Purchase of tickets constitutes acceptance of these Terms and Conditions. If any clause is found to be unenforceable, the remaining clauses will continue in full force and effect.



BIRD’S BASEMENT JAZZ MILES CLUB PROGRAM

There is a maximum number of Jazz Miles available for redemption per show.

1. Points Value

1.1 One (1) Jazz Miles Club point is equivalent to AUD $0.05.
1.2 Twenty (20) Jazz Miles Club points are equivalent to AUD $1.00.

2. Earning Points

2.1 Jazz Miles Club points are earned on advance ticket purchases only.
2.2 Purchases must be made via a registered Jazz Miles Club online account.
2.3 Points are allocated after attendance at the relevant performance.

3. Use of Points

3.1 Jazz Miles Club points:
(a) cannot be transferred or redeemed for cash;
(b) cannot be used on the night of the show;
(c) expire two (2) years from the date they are earned; and
(d) are not reinstated if a ticket is cancelled, regardless of the timing or reason for cancellation.

3.2 Bird’s Basement reserves the right to amend, suspend, or discontinue the Jazz Miles Club Program at its discretion.

4. Jazz Miles Redemption

4.1 Jazz Miles are subject to availability and a maximum number of Jazz Miles may be redeemed per show, similar to airline frequent-flyer reward allocations.

4.2 The number of Jazz Miles available for redemption for any performance may vary depending on the artist, performance date, seating category, and overall demand.

4.3 Once the Jazz Miles allocation for a particular show has been exhausted, no further Jazz Miles may be redeemed for that performance, even if tickets remain available for purchase using other payment methods.

4.4 Jazz Miles cannot be reserved, waitlisted, or guaranteed for any specific performance.

4.5 Bird’s Basement reserves the right to determine, adjust, or withdraw Jazz Miles redemption limits for any show at its discretion and without prior notice.

USE OF INFORMATION

When you are online, we collect information regarding the pages within our network which you visit and what you click on. As a general rule we do not collect sensitive information. However, if we do, it will usually be for the purposes of providing our goods or services and if the law requires us to, we will seek your consent to collect it.

We use your information to provide our services to you, to fulfil administrative functions associated with these services, for example billing, to enter into contracts with you or third parties and for marketing and client relationship purposes. Your contact details may be used to contact you to inform you of important information related to an event you have purchased tickets to, for example time or event changes or event cancellation. Where your personal information is contained within an advertisement which we publish for you, we may also use your information for publication of that same advertisement in other media, in accordance with the terms and conditions of the initial publication.

If at the time of purchase you agreed to receive information and offers about future events directly from the venue operator and/or promoter(s) of the event by the ticketing platform, then they will provide your contact details to Bird's Basement for this purpose. Bird's Basement may use these details to contact you with information and offers regarding future events and promotions or similar business. If you wish to change this choice you can contact us. Bird's Basement will use your personal information in accordance with Bird's Basement’s privacy policies. If wish to unsubscribe from this communication you should contact Bird's Basement directly.

USE OF AGGREGATE DATA

We may collect certain non-personal information to optimise our goods and services including our Web pages for your computer (e.g., the identity of your Internet browser, the type of operating system you use, your IP address and the domain name of your Internet service provider). We may use such non-personal information for internal purposes, including but not limited to improving the content of our sites.

Bird's Basement may use personally identifiable information in aggregate form to improve our goods and services including our Web sites and make them more responsive to the needs of our customers.

SECURITY

Bird's Basement strives to ensure the security, integrity and privacy of personally identifiable information of our customers. We use a variety of physical and electronic security measures including restricting physical access to our offices and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure.
Unfortunately, no data transmission over the Internet can be guaranteed to be totally secure.

Cookies are data that a Web site transfers to an individual’s hard drive for record-keeping purposes. Cookies can facilitate a user’s ongoing access to and use of a site. They allow us to track usage patterns and to compile data that can help us improve our content and target advertising. Remember to close your browser when you have finished your user session. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe. You as an individual are responsible for the security of and access to your own computer.
Whenever you voluntarily disclose personal information over the Internet this information can be collected and used by others. In short, if you post personal information in publicly accessible online forums, you may receive unsolicited messages from other parties in return.
